# Presumption of Conformity

> The legal effect by which a product conforming to a cited harmonised standard is presumed to meet the corresponding legal requirements.

## Definition

Presumption of conformity is the legal effect by which a product that conforms to a harmonised
standard, or parts of it, whose reference has been published in the Official Journal is presumed
to comply with the requirements covered by that standard.

## Expanded Explanation

The presumption is rebuttable and partial. It is rebuttable because an authority may still challenge
compliance on evidence. It is partial because it extends only to the requirements the standard
actually covers, so applying one harmonised standard rarely discharges every requirement that
applies to a product.

Where no suitable harmonised standard exists, the Commission may adopt common specifications by
implementing act, which produce the same presumption for the requirements they cover.

Nothing obliges a manufacturer to use a harmonised standard. The alternative is to demonstrate
compliance directly, which is lawful but places the whole evidential burden on the technical
documentation.

## Why It Matters

Presumption of conformity is the practical reason standards work matters commercially. It converts a
contested technical argument into a documented reference.

## Legal and Regulatory Context

Regulation (EU) 2024/1781, Articles 40 and 41 on harmonised standards and common specifications,
read with Regulation (EU) No 1025/2012.

## Relationship to Adjacent Concepts

Presumption of conformity is the effect; harmonised standards and common specifications are the
instruments that produce it.

## Common Misconceptions

#### Presumption of conformity means the product cannot be challenged

It shifts the starting position, not the outcome. A market surveillance authority may still find
non-compliance on the evidence.
