# Delegated Act

> A legally binding act adopted by the European Commission under powers granted by a framework regulation, used to set the detailed product specific requirements of the ESPR.

## Definition

A non legislative act of general application adopted by the European Commission under Article 290
of the Treaty on the Functioning of the European Union, which supplements or amends non essential
elements of a framework law. Under the Ecodesign for Sustainable Products Regulation, delegated
acts set the actual requirements for each product group.

## Expanded Explanation

A framework regulation states what the Commission may require. A delegated act states what is
required, for which products, from when. For Digital Product Passports this distinction is the whole
planning problem: the framework tells you the passport will exist, the delegated act tells you which
data fields your product must carry, which are public, which are restricted, and how long the
passport must remain available.

Delegated acts are prepared with stakeholder consultation and preparatory studies, then subject to a
scrutiny period during which the European Parliament and the Council may object. Once in force they
are directly binding, and they normally include a transition period before the requirements apply.

Delegated acts should not be confused with implementing acts, which are adopted under Article 291
and concern uniform conditions for implementing existing rules rather than supplementing them.

## Why It Matters

The delegated act is the document that converts a general expectation into an auditable
specification. Organisations that wait for their delegated act before starting any work usually find
the transition period too short, because the hard part is not publishing a passport but obtaining
verified data from suppliers. The workable position is to build identifier and data foundations
under the framework, then map fields once the delegated act is adopted.

## Common Misconceptions

#### One delegated act covers everything

There is no single passport delegated act. Requirements arrive product group by product group,
each with its own data set and timetable, so an organisation with a mixed portfolio may face
several different obligations at different dates.
